1. About these terms

These Terms of Service govern your access to and use of the Southern Muse Gallery website and your purchase of products from us.

In these terms, “Southern Muse Gallery”, “we”, “us” and “our” refer to Southern Muse Gallery, an Australian business operating in Victoria. “You” and “your” refer to a visitor to our website or a customer purchasing from us.

By accessing our website or placing an order, you agree to these Terms of Service, together with our:

  • Privacy Policy;
  • Return and Refund Policy; and
  • Shipping Policy.

Please do not use our website or place an order if you do not agree to these terms.

Nothing in these terms excludes, restricts or modifies any right or remedy that cannot legally be excluded, restricted or modified, including rights under the Australian Consumer Law.

2. Eligibility and customer information

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order through our website.

You agree to provide accurate, complete and current information when placing an order, including your name, email address, billing information and delivery address.

You are responsible for checking your order information before submitting payment.

3. Products

Southern Muse Gallery sells wall-art products, including made-to-order fine-art prints.

We take reasonable care to describe our products accurately and display representative images. However:

  • colours may appear differently depending on your screen, display settings and lighting;
  • product mockups may not represent the exact physical scale of the artwork;
  • minor variations may occur between the on-screen image and the finished print; and
  • cropping may vary slightly where different print sizes or proportions are offered.

The product dimensions and specifications stated on the relevant product page should be used when making your purchase decision.

These reasonable visual variations do not limit your rights where a product is faulty, damaged, materially different from its description or otherwise fails to meet a consumer guarantee.

We may change or discontinue products and product options at any time. These changes will not affect orders that we have already accepted unless we contact you and agree on an appropriate solution.

4. Made-to-order products

Our fine-art prints are generally produced after an order is placed.

Please review the selected artwork, size, product format and delivery information carefully before completing your order.

Because production may begin shortly after an order is accepted, we may not be able to accommodate cancellation or change requests once production has commenced.

Our cancellation and change-of-mind conditions are explained in our Return and Refund Policy. Nothing in this section limits your rights under the Australian Consumer Law.

5. Orders and acceptance

Submitting an order is an offer to purchase the selected products.

An automated order acknowledgement does not necessarily mean that we have accepted the order. We may decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • pricing or product information contains a genuine error;
  • payment cannot be authorised;
  • we reasonably suspect fraud or unauthorised activity;
  • we cannot deliver to the supplied address; or
  • accepting the order would breach a law or regulatory requirement.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product and any related delivery charge.

We will contact you using the information supplied with your order where clarification or corrective action is required.

6. Prices and payment

All prices displayed on our website are in Australian dollars unless otherwise stated.

The total amount payable, including applicable delivery charges and any taxes required to be shown, will be displayed before you complete payment.

Prices may change without notice, but a price change will not affect an order that we have already accepted, except where there is an obvious or genuine pricing error.

You confirm that you are authorised to use the payment method provided and that the submitted payment information is accurate.

Payments may be processed through Shopify and third-party payment providers. Their own terms and privacy practices may also apply to the processing of your payment.

7. Shipping and delivery

Orders are produced and delivered in accordance with our Shipping Policy.

Production and delivery dates are estimates unless we expressly confirm otherwise.

We will take reasonable steps to fulfil orders within the stated or agreed timeframe and to communicate significant delays where we become aware of them.

Southern Muse Gallery remains responsible for addressing delivery problems relating to products purchased directly from us. Customers will not be required to resolve product or delivery disputes directly with our printer or fulfilment supplier.

You are responsible for providing a complete and accurate delivery address. Additional charges may apply if an order must be redirected or resent because incorrect or incomplete information was provided by you.

Nothing in this section limits any right or remedy available under the Australian Consumer Law.

8. Returns, refunds and product problems

Returns, refunds, replacements, cancellations and claims involving damaged, faulty or incorrect products are governed by our Return and Refund Policy.

We do not generally offer returns or refunds solely because a customer changes their mind. However, this does not affect rights relating to faulty, damaged, unsafe, misdescribed or otherwise non-compliant products.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, customers may be entitled to a repair, replacement, refund, cancellation or compensation for reasonably foreseeable loss or damage.

9. Intellectual property

Unless otherwise stated, the website and its content—including artwork images, photographs, text, logos, graphics, product descriptions, layouts, branding and design elements—are owned by or licensed to Southern Muse Gallery.

The content is protected by applicable Australian and international intellectual-property laws.

You may access and use the website for personal, non-commercial shopping purposes.

Without prior written permission, you must not:

  • reproduce, copy or distribute website content;
  • download or use artwork files for printing or resale;
  • modify or create derivative works from our artwork or content;
  • use our business name, logo or branding;
  • commercially exploit any part of the website; or
  • remove copyright, trademark or ownership notices.

Purchasing a print does not transfer copyright or grant reproduction, commercial-use or resale rights in the underlying artwork.

10. Acceptable website use

You must not use the website:

  • for unlawful, fraudulent or malicious purposes;
  • to interfere with the website’s security or operation;
  • to introduce malware, viruses or harmful code;
  • to obtain unauthorised access to accounts, systems or information;
  • to collect personal information about other users without authority;
  • to infringe another person’s rights;
  • to submit false, misleading, defamatory, abusive or unlawful material; or
  • to reproduce or commercially exploit website content without permission.

We may restrict or suspend access where we reasonably believe a user has breached these requirements or created a security, legal or operational risk.

11. Third-party services and links

Our website is hosted and supported by Shopify.

Products purchased through our store are sold by Southern Muse Gallery, not Shopify. Shopify provides the ecommerce platform and may process information as described in the relevant privacy policies.

Our website may also include links to third-party websites, payment services or applications. We are not responsible for third-party content or services that are outside our reasonable control.

You should review the terms and privacy policies of a third party before using its services.

12. Privacy

We collect, use and disclose personal information in accordance with our Privacy Policy.

Because our store is hosted by Shopify, information may also be processed by Shopify and by service providers involved in payments, order fulfilment, communication, analytics and delivery.

13. Website availability and information

We take reasonable care to keep the website available and its information accurate.

However, the website may occasionally be unavailable because of maintenance, technical faults, security issues or events beyond our reasonable control.

We may correct genuine errors or omissions relating to product descriptions, availability, prices or delivery information.

Where an error affects an order already placed, we will contact you and provide an appropriate solution, which may include confirming the corrected information or cancelling and refunding the affected order.

14. Liability

Nothing in these terms excludes, restricts or modifies:

  • the Australian Consumer Law;
  • any applicable consumer guarantee;
  • liability for fraud, wilful misconduct or negligence where that liability cannot legally be excluded; or
  • any other right, remedy or liability that cannot legally be excluded or limited.

To the extent permitted by law, Southern Muse Gallery is not liable for indirect or consequential loss that was not reasonably foreseeable when the relevant contract was formed.

We are not responsible for loss caused by:

  • your failure to provide accurate order or delivery information;
  • unauthorised use of your account caused by your failure to protect your login details;
  • use of the website contrary to these terms; or
  • events outside our reasonable control where we have taken reasonable steps to minimise the impact.

This section must be interpreted subject to all applicable consumer-protection laws.

15. Events outside our reasonable control

We are not responsible for a delay or failure caused by events outside our reasonable control, including severe weather, natural disasters, carrier disruptions, industrial action, major system outages, supply interruptions or government restrictions.

Where such an event affects an accepted order, we will take reasonable steps to communicate with you and provide the product within a reasonable time or offer another remedy where required by law.

16. Changes to these terms

We may update these Terms of Service to reflect changes to our products, website, operations or legal obligations.

Updated terms will be published on this page with the revised effective date.

Changes will generally apply from the date they are published and will not retrospectively reduce rights relating to an order already accepted.

Where required by law, we will provide appropriate notice of material changes.

17. Severability

If any part of these terms is found to be unlawful, invalid or unenforceable, that part will be read down or removed to the minimum extent necessary.

The remaining provisions will continue to operate.

18. Governing law

These terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws.

The courts and tribunals of Victoria and Australia may hear disputes relating to these terms.

Nothing in this section prevents a consumer from exercising any right to bring a claim in another jurisdiction where that right is provided by law.
